Welcome to the Instagramos System

Thank you for using our products and services (“Services”). These Services are provided by Instagramos, operated by Arcomdi Comercial Ltda. By using our Services, you agree to these Terms. Please read them carefully.

INSTAGRAMOS SYSTEM USER AGREEMENT

This User Agreement (“Agreement”) is entered into between you and Arcomdi Comercial Ltda., registered under CNPJ No. 49.710.415/0001-48, located at R. Pensilvania, 114 Bloco 03 Cj. 284, CEP 04564-000, São Paulo/SP, Brazil, and governs the terms and conditions for the provision of Instagramos Services.

ACCEPTANCE OF TERMS

By registering on and using the Instagramos System website, including uploading or downloading images and providing account information for the production of our products, you acknowledge and agree that by clicking “Accept Terms of Use,” you automatically agree to be bound by these Terms and Conditions, the Instagramos System User Agreement, any future amendments, and our Privacy Policy.

This Agreement applies both to individual users and, where applicable, to legal entities represented by users authorized to act on their behalf.

Instagramos reserves the right to modify this Agreement periodically at its sole discretion. Continued use of the website and Services constitutes acceptance of the most current version available at the time of use.

If you do not agree with these Terms, you must not access or use the website, Services, or any related systems.

By accepting these Terms, you confirm that:

  • You are at least 18 years old or legally emancipated; or

  • You have authorization from a parent or legal guardian fully capable of consenting to these Terms.

Parents and legal guardians shall be jointly liable for any damages caused by minors under their responsibility.

Users agree not to use the Instagramos System to upload, store, transmit, or share any content that is unlawful, offensive, pornographic, obscene, defamatory, threatening, discriminatory, or otherwise harmful or illegal under applicable law.

USER RESPONSIBILITIES

By using our Services, you agree that:

  • All registration information provided is true, accurate, and complete;

  • You are responsible for maintaining the confidentiality of your password;

  • You accept full responsibility for all activities conducted under your account.

Users are solely responsible for any content uploaded, edited, published, transmitted, or shared through the Instagramos platform, including images, artwork, photographs, and related materials.

Instagramos does not maintain backup copies of uploaded files.

The Services may be accessed internationally, subject to Brazilian law, and users expressly authorize the processing of their images in Brazil.

Instagramos shall not be liable for damages arising directly or indirectly from system failures, data loss, transfer interruptions, unauthorized access, or any breach of obligations by users.

INTELLECTUAL PROPERTY RIGHTS

The Instagramos name, trademarks, logos, layout, software, website design, images, graphics, text, videos, music, and all related materials are the exclusive property of Instagramos and/or its licensors and are protected under applicable intellectual property laws.

Nothing in this Agreement grants users any ownership rights over such materials.

Without prior written authorization from Instagramos, users may not:

  • Reproduce, modify, distribute, license, sell, or commercially exploit any content from the website;

  • Reverse engineer, decompile, or attempt to access the source code of the platform;

  • Use Instagramos trademarks or branding in a misleading or unauthorized manner.

Users acknowledge that all software and systems provided by Instagramos are protected under Brazilian Copyright Law (Law No. 9.610/98), Software Law (Law No. 9.609/98), and international treaties.

Users are fully responsible for any violations of intellectual property rights and agree to indemnify Instagramos against any resulting claims or damages.

SERVICES

The Instagramos System provides a B2B2C e-commerce platform specializing in the creation of personalized mosaics using photographs and artwork uploaded by users or accessed through connected social media accounts.

Upon registration, users receive access credentials allowing them to use the Services through internet-connected devices and supported web browsers.

Users are solely responsible for maintaining the security of their devices and login credentials.

ACCOUNT AND ACCESS POLICY

Usernames, nicknames, and account information may not:

  • Be offensive;

  • Include personal data;

  • Contain URLs or electronic addresses;

  • Misrepresent Instagramos or third parties.

Instagramos reserves the right to refuse, suspend, or terminate accounts that violate these Terms.

Instagramos may suspend or terminate user access if:

a) The user violates this Agreement or related policies;

b) The user fails to fulfill their obligations;

c) Fraudulent or malicious activities are detected;

d) User identity cannot be verified or submitted information is inaccurate.

GENERAL PROVISIONS

These Terms do not establish any employment, partnership, or agency relationship between Instagramos and users, artists, photographers, merchants, or suppliers.

Instagramos may update these Terms at any time. Continued use of the Services after publication of updated Terms constitutes acceptance of those changes.

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

The Services are provided “as is” and “as available,” without warranties of uninterrupted or error-free operation.

Instagramos shall not be liable for direct, indirect, incidental, consequential, moral, or material damages arising from the use of the platform or transactions between users.

Failure by Instagramos to enforce any provision of these Terms shall not constitute a waiver of its rights.

The use of software, devices, scripts, bots, or any resource intended to interfere with the operation of the platform or its databases is strictly prohibited and may result in legal action.

SANCTIONS

Instagramos reserves the right, at its sole discretion, to suspend or permanently terminate user accounts for violations of these Terms, fraudulent conduct, false information, or any activity harmful to the platform or other users.

Users agree to indemnify and hold harmless Instagramos, its affiliates, directors, employees, partners, suppliers, and representatives from any claims, liabilities, damages, or expenses arising from their misuse of the Services or violation of these Terms.

ABOUT INSTAGRAMOS

Instagramos is an exclusive B2B2C e-commerce platform designed for the creation and commercialization of personalized mosaics using users’ personal photos or images from the Instagramos gallery and image bank.

Products are sold according to the descriptions, pricing, and commercial conditions presented on the platform.

WEBSITE OWNERSHIP

The website https://instagramos.com and all related content are owned exclusively by Arcomdi Comercial Ltda. All rights reserved.

These Terms of Use define the rules governing access to and use of the Instagramos platform, without prejudice to applicable legislation.

Users are fully responsible for all activities conducted through their accounts and agree not to sell, transfer, license, or assign their accounts or account rights.

All information provided during registration must be accurate, current, and complete.

Registration and use of the Instagramos System imply full acceptance of these Terms.

ACCESS CONDITIONS

Access to the Instagramos platform is free and available through any internet-connected device.

Account registration is intended exclusively for individuals aged 18 or older who possess legal capacity.

Minors or legally incapacitated individuals may only access the platform if duly represented or assisted by their legal guardians throughout the use of the Services.
